1. Introduction

Welcome to ATAF Construction. By accessing or using our services, you agree to comply with and be bound by the following Terms and Conditions. These terms govern your use of our construction services and outline our obligations to you as a client.

2. Scope of Services

ATAF Construction provides construction, renovation, and related services as specified in your project contract. Services are carried out professionally and in accordance with Australian regulations and standards. The specific scope of each project will be outlined in a written contract agreed upon by both parties.

3. Quotes and Estimates

All quotes and estimates provided by ATAF Construction are valid for 30 days from the date of issue. Pricing may vary based on changes to the scope, materials, or unforeseen circumstances. Any additional work outside of the original scope will be quoted separately and requires written approval.

4. Payment Terms

Clients are required to adhere to the payment schedule as outlined in their contract. Payments may include a deposit prior to commencing work, progress payments, and a final payment upon completion. All payments are due within 14 days of the date of the invoice, unless otherwise agreed in writing.

5. Site Access and Responsibilities

Clients must ensure our team has adequate access to the construction site during the agreed working hours. Clients are also responsible for securing all necessary permits, unless specifically agreed otherwise. It is essential that the work area is free from obstruction or hazards before and during the construction process.

6. Variations

Any variations to the scope of work must be submitted in writing. Variations may result in adjustments to costs and completion timelines. ATAF Construction will provide written confirmation and a revised quote for any requested changes.

7. Health and Safety

We are committed to maintaining the highest standards of safety on-site. All work is carried out in compliance with Australian Work Health and Safety (WHS) regulations. Clients are required to respect safety barriers and avoid entering restricted areas during construction.

8. Warranties and Guarantees

ATAF Construction provides a standard warranty for workmanship in compliance with Australian consumer law. Any product-specific warranties will be passed on to the client. Warranty claims must be submitted in writing within the warranty period.

9. Liability

ATAF Construction will not be held liable for delays or damages caused by circumstances beyond our control, including but not limited to extreme weather conditions, third-party actions, or supply chain disruptions. Our liability is limited to the value of the services provided.

10. Termination

Either party may terminate the contract by providing written notice, subject to applicable terms. If the client chooses to terminate services, ATAF Construction reserves the right to charge for work completed up to the date of termination, along with any related costs.

11. Dispute Resolution

In the event of a dispute, both parties agree to seek resolution through negotiation in good faith. Should negotiations fail, the parties may proceed to mediation or arbitration in accordance with Australian dispute resolution procedures.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Australia. Any legal action must be brought in an Australian court of competent jurisdiction.

13. Changes to Terms

ATAF Construction reserves the right to update or modify these Terms and Conditions from time to time. Clients will be notified of any significant changes, and continued use of our services will indicate acceptance of the revised terms.
